Partner Visa in Australia: Your Guide for 2024

A Partner Visa allows the partner of an Australian citizen, permanent resident, or New Zealand citizen to migrate to Australia to live and work. This visa also covers de-facto and same-sex relationships.

 

Types of Partner Visas

There are two main types of Partner Visas: the prospective marriage visa and the standard Partner Visa for those who are married or in a de-facto relationship.

Prospective Marriage Visa

This visa is for people outside Australia who intend to marry their Australian sponsor after arriving in Australia. Key requirements include:

  • Applicants must be at least 18 years old.
  • They must have met their sponsor in person since both turned 18.
  • They must be known to their sponsor.
  • They must be able to enter into a marriage valid under Australian law.

The prospective marriage visa is valid for nine months. Visa holders must enter Australia, marry their sponsoring partner, and apply for a Partner Visa within those nine months.

Partner Visa in Australia

This visa is for those married to or in a de facto relationship with an Australian partner. Applications can be made in or outside Australia. Key requirements include:

  • A mutual commitment to a shared life together.
  • A genuine and continuing relationship.
  • Living together or not living separately permanently.

Married applicants must show their marriage is valid under Australian law. De facto applicants must show their relationship has existed for at least 12 months before applying. This period can be waived if the relationship is registered.

 

Application Process

Applicants submit one form and pay one charge. The Department assesses the application in two stages. First, a temporary Partner Visa is granted. Then, a permanent Partner Visa is granted, usually two years later, if the relationship continues. Exceptions include:

  • Relationships longer than five years.
  • Couples married or in a de facto relationship for more than two years with children.

Sponsorship and Dependents

Applicants need sponsorship from their partner, who must be an Australian citizen, permanent resident, or eligible New Zealand citizen, aged 18 or older. Dependents can be included in the application, depending on their location and visa status.

Benefits and Requirements

The temporary Partner Visa allows unlimited rights to live and work in Australia. It also allows for a permanent Partner Visa application after two years, with some exceptions. All applicants must meet health and character requirements.
